. and to underscore that point, which i think does get to what steve said a little earlier, and that is, obviously -- you can have a discussion, and you can have a set of of policies, but we're going to be as good as our national congress setting a floor with legislation. and if california wands to exceed it for whatever or reason, they'll go farther. but the national discussion, and i think the it's one of the priorities in the discussion tomorrow and i think you can get bipartisanship on it. when the background checks were set up because of of what happens at gun shows and everything else, 40% of the guns that are traded or bought are not covered with any background five-day waiting period. that's not a loophole, that's an exemption. and that has to be dealt with so you create a national floor that's comprehensive so what happens in indiana doesn't flood the city of chicago, cook county. and it's essential to underscore that point. >> if i could, it needs to be a national be fix, and it has to be federal preemption because the patchwork of states or cities working by themselves is not effective.

broadly written and ambiguousus that prosecutors, like steve heineman, who just want, as i said earlier, just won a notch on their belts, can throw the book or to charge someone with 35 years in prison for miley and considered behavior -- mildly consideand consider behavior. why does someone like steve heineman have the power to do this, unbridled power? why would you charge someone with up to 35 years in prison if he actually think all the desert is six months as the plea deal suggested? this happens to people every day and must have your resources than aaron and much less support, and don't have the option necessarily of even considering hiring a lawyer and going to try all over the course of two years and are forced to take the plea deals when they're not guilty or the plea deals are completely unjust. when a broad criminal justice reform in this country. we incarcerate more people per capita than any other country in the world. we do not have lower crime rates because of it. there is justice and there is justice. right now our system does not promote justice. our system is punitive.

into the politics that can get this jammed up literally. not to argue with steve but i will. there's nothing magical about ten. and i will say this. we did a forum -- there's federal legislation today that relates to shotgun clips that are ban no more than three at any one time. we are more -- it's a federal legislation that covers alabama, mississippi, southern illinois. so willing to good to three in the clip. so we're there. but that said -- the clip does change. the assault clip changes the type of gun. it dramatically changes it. two, i do think a comprehensive background check that deals with criminal activity would be essential to closing the loophole. the seller pieces you can. i think he has to direct the attorney general as a measure of each u.s. attorney, what they're doing on gun prosecutions. we have a u.s. attorney position here in the city of chicago that opened up. our gun prosecutions in the city, compared to other utah attorneys, lags other ones. there should be a standard and they should be measured and have to report, and that is within the executive authority because you have gu

in general, something that steve taught us about for many years was eroded. there were some relatively narrow exceptions to the plcaa that allowed the lawsuits to proceed nevertheless. and new york city took advantage of one of those exceptions. one of those exceptions is the basis of the lawsuits that the dealer was knowingly making any illegal sales. so, as mayor bloomberg alluded to this morning in his opening presentation, new york city used crime gun trace data to identify a bunch of dealers that were disproportionately supply and the guns that ultimately got picked up from criminals in new york city today engaged in the undercover investigations of those dealers. 27 of them were caught making illegal sales and new york city brought lawsuits against them. 25 of them ultimately settled and agreed to dramatically change their sales practices. if they agreed to be supervised by the court-appointed special master there would make sure that they had implemented these ways to make it harder for the straw purchases and other kinds of illegal sales to occur. so daniel webster and i and others ha
